PRIVATE OFFICE BOX TERMS AND CONDITIONS
1. These terms and conditions apply to persons approved by Kings Cash as users of the post office box or locked bag service.
2. INTERPRETATION
Except where the context or subject matter otherwise indicates or requires:
- Agreement means the agreement between by Kings Cash and the Customer or provision of the service in accordance with these terms and conditions.
- Box means a Private Mail Box supplied by Kings Cash.
- Service means the Private mail box service supplied by Kings Cash for the purpose of mail delivery
- Customer means the person or body in whose name the application for use of the service is made and any authorised transferee or assignee thereof.
1 PERIOD OF SERVICE
The service may be provided on a temporary basis as specified on the application or for an indefinite period unless cancelled or terminated sooner in accordance with these terms and conditions.
2 CHARGES
a) Charges for use of the service shall be determined by Kings Cash from time to time and are payable in advance.
b) Charges will be calculated from the first day of the calendar month in which the service commences to the last day in the calendar month in which the service ends.
3 REFUND OF CHARGES
Where the agreement is cancelled pursuant to clause 11, the Customer is entitled to a refund the amount of the refund to be calculated on the remaining number of whole calendar months paid for, less an administrative fee determined by Kings Cash. A refund will not be payable where the agreement is terminated by Kings Cash under clause 12, or where the amount of the refund is equal to or less than the administration fee.
4 DELIVERY OF MAIL
All mail, other than parcels addressed to a Customer's street address, addressed to a Customer or to the Customer's or box reserved at the office where their box or bag is located will be delivered to that box.
5 POSTAL ADDRESS
The Customer will show their postal address, including their box number, prominently on letterheads, other appropriate stationery and in any advertising, with the request that all mail be addressed to that postal address.
6 TRANSFER OF SERVICE
a) A customer shall not assign or transfer the right to use the service without the prior written consent of Kings Cash and the payment of a transfer fee. Any assignment or transfer without such consent will be void and of no effect.
b) Where a partnership holding a box or bag is reconstituted by the retirement, death or addition of more partners, the reconstituted partnership is deemed to be the Customer.
7 CHANGE OF ADDRESS
The Customer shall notify by Kings Cash in writing within seven days of any change of address from the address given on the application.
8 CANCELLATION
The Customer may cancel a service at any time upon seven (7) days notice in writing. Unless an application for redirection or holding is made all mail addressed to that box or bag shall, following the notice period, be treated as undeliverable.
9 TERMINATION
Kings Cash may terminate the agreement at any time by giving written notice specifying the date of termination to the Customer if:
a) The customer fails to observe or perform any term, covenant or obligation contained in these terms and conditions:
b) Kings Cash has reason to believe that the Customer has used a fictitious or assumed name on the application:
c) Kings Cash has reason to believe the address on the application is not the Customer's current residential or business address:
d) The box is being used by a person other than the Customer or for a purpose other than the delivery of postage paid mail:
e) Kings Cash has reason to believe that the Customer, or a person known to the Customer, intends to use, or is using the service in the furtherance of an offence against the law of Australia or any State, Territory or overseas country, or to prevent the detection of the offence or the offender.
The Customer regularly allows an accumulation of mail beyond the capacity of the box or bag and will not, upon the request of Kings Cash, agree to obtain or provide a larger or additional box or bag.
5 LIABILITY AND INDEMNITY
a) Subject to paragraph (c), Kings Cash shall not be liable to any person for any loss or damage suffered or that may be suffered, as a result of any act or omission, whether negligent or otherwise, by or on behalf of Kings Cash in relation to the provision of the service pursuant to the agreement or arising out of any matter or thing relating to the agreement
b) The Customer shall indemnify Kings Cash against any loss or damage what so ever which Kings Cash may suffer as a result of any action, proceeding, claim, demand or prosecution, arising from the provision of the service or any other matter or thing relating to the agreement, including loss or damage arising from the negligent acts or omissions of Kings Cash, pursuant to the agreement.
c) To the extent permissible by law, Kings Cash expressly disclaims all conditions and warranties, express or implied, in respect of the provision of the service pursuant to the agreement. Where the law precludes such exclusion and implies certain conditions and warrantees into the agreement, the liability of Kings Cash for breach of such condition or warranty shall be limited, at the option of by Kings Cash, to any one or more of the following:
(i) The supplying of the services again:
(ii) The payment of the cost of having the services supplied again
5 VARIATION
These terms and conditions may be added to or varied from time to time by Kings Cash by notice in writing to the Customer or by mutual agreement between the parties.
6 NOTICE
Any notice required to be serviced by or under these terms and conditions shall be sufficiently given to the Customer if left in the box or bag provided pursuant to the agreement and to Kings Cash if sent by post or given to the Manager responsible for the facility at which said box or bag is situated.
7 WHOLE AGREEMENT
This agreement contains the whole of the agreement between the parties and any representation or warranty made by either party prior to entering into this agreement shall have no force or effect
8 DELIVERY
The provision of a post office box or locked bag shall not constitute or imply any agreement between Kings Cash and the Customer (or any undertaking or obligation whatsoever on the part of Kings Cash) with respect to the carriage or delivery of any postal article. The Australian Postal Corporation Act 1989, the Regulations and the General Postal Services Terms and Conditions made pursuant to the Act apply to the carriage and delivery of postal articles.
